Employers in most countries have few restrictions when it comes to testing their employees. However, employers in the United States are more restricted, and are only permitted to request that employees submit to a polygraph exam under some specific conditions, as provided for by Federal Law (EPPA). There are two types of exams typically requested by U.S. employers, the Pre-Employment Exam and the Specific Loss Exam. Most other countries are not so limited, and offer a third testing option… Periodic Lie Detector Tests.
In the United States, the Employee Polygraph Protection Act of 1988 established Federal regulations for when an employer can request that an employee submit to polygraph testing. Many individual states have more restrictive laws and regulations in place, which supercede the Federal regulations. In other words, if a particular State prohibits employment-related polygraph testing, that restriction is primary (see list below).

Alaska, California, Connecticut, Delaware, District of Columbia (only pre-employment testing prohibited), Iowa, Massachusetts, Michigan, Minnesota, New Jersey, Ontario Province (Canada), Rhode Island, Vermont, West Virginia (permitted only for employees handling pharmaceuticals).
